By accessing or using SchoolDigger.com (the "Site"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not use the Site. Continued use of the Site after any modification to these Terms constitutes your acceptance of the revised Terms. These Terms apply to all visitors, users, and others who access the Site.

USE OF THIS SITE
Claarware LLC ("Claarware") maintains SchoolDigger.com for your personal information, education, and communication. You may browse the Site and download material displayed on the Site for non-commercial, personal use only, provided you retain all copyright and other proprietary notices contained on the materials. You may not distribute, modify, transmit, reuse, repost, or use the content of the Site for public or commercial purposes — including text, images, audio, video, data, rankings, ratings, scores, or any other content — without Claarware's prior written permission.

PROHIBITED USES
Without the express prior written permission of Claarware LLC, you may not use the Site or its content in any of the following ways:

Automated access: You may not use bots, spiders, scrapers, crawlers, scripts, headless browsers, automated tools, or any other programmatic or non-human means to access, browse, collect, copy, monitor, or extract data or content from the Site, regardless of the method used or the purpose intended.
Commercial data redistribution: You may not reproduce, sell, license, sublicense, publish, or otherwise commercially distribute data, rankings, ratings, scores, enrollment figures, school profiles, district information, or any other content obtained from the Site.
Competing products or services: You may not use data or content from the Site to build, train, populate, operate, or enhance a competing product, service, dataset, database, or application.
AI and machine learning training: You may not use content from the Site to train, fine-tune, or develop artificial intelligence or machine learning models, large language models, or similar systems without Claarware's express written permission.
API circumvention: You may not use automated or manual means to obtain data that is available through SchoolDigger's licensed API products (developer.schooldigger.com) without a valid, authorized API license agreement.
Bulk or systematic downloading: You may not systematically download, cache, archive, or store substantial portions of the Site's content in any form.
Circumventing access controls: You may not attempt to circumvent, disable, or otherwise interfere with any security feature, rate limiting, bot detection, CAPTCHA, or access control mechanism on the Site.
Tool or service creation: You may not create, publish, distribute, or operate any tool, service, actor, script, or product whose purpose or primary function is to scrape, extract, or collect data from the Site, regardless of whether you use that tool yourself or make it available to others.

Violations of these prohibitions constitute a material breach of these Terms. Claarware reserves the right to immediately terminate your access to the Site, seek injunctive relief without bond, and pursue all other available legal remedies, including damages, against any party that violates these Terms. Each violation may be treated as a separate actionable claim.

PROPRIETARY DATA AND DATABASE RIGHTS
The school rankings, ratings, scoring methodologies, data compilations, and related content on this Site represent original creative and intellectual work developed by Claarware LLC over many years and constitute proprietary compiled databases protected under U.S. copyright law (17 U.S.C. § 103) and applicable state and common law. While individual underlying facts (such as publicly reported test scores or enrollment numbers) may not be independently copyrightable, Claarware's original selection, arrangement, weighting, scoring, ranking methodology, and presentation of that data are protected by copyright and constitute valuable proprietary assets of Claarware LLC. No license to use this data, in whole or in part, is granted by these Terms or by access to the Site.

TRADEMARKS AND COPYRIGHT NOTICE
Unless otherwise noted, product names, designs, logos, titles, text, images, audio, video, and data within this Site are the trademarks, service marks, trade names, copyrights, or other intellectual property of Claarware LLC. All other unregistered and registered trademarks are the property of their respective owners. Nothing on the Site should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any of Claarware's intellectual property without the prior written permission of Claarware.

COMMUNICATIONS WITH THIS SITE
You are prohibited from posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic, or profane material, or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law. Claarware will fully cooperate with any law enforcement authorities or court order requesting or directing Claarware to disclose the identity of anyone posting such information or materials.

Claarware prohibits the harvesting of email addresses or other personal contact information from this Site for the purpose of sending unsolicited communications. Any communication or material you voluntarily transmit to the Site by email or otherwise — including data, questions, comments, or suggestions — is, and will be treated as, nonconfidential and non-proprietary. Anything you transmit may be used by Claarware for any purpose, including reproduction, disclosure, transmission, publication, broadcast, and posting.

UNAFFILIATED PRODUCTS AND SITES
Descriptions of, or references to, products, publications, or sites not owned by Claarware or its affiliates do not imply endorsement. Claarware has not reviewed all material linked to the Site and is not responsible for the content of any such material. Your linking to other sites is at your own risk.

You agree that any dispute arising out of or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in King County, Washington. By using this Site, you consent to personal jurisdiction in those courts.
